Terms and Conditions

All purchases made through the website are governed by the general conditions of sale set out below.

1. Definitions

  • Caffè Italia dei f.lli Russo is hereinafter referred as Caffè Italia,
  • is hereinafter referred as Site.

2. General terms and conditions

All methods of sale, delivery and payment are listed in detail in the various sections of the Site and during Checkout and are to be considered an integral and substantial part of this contract. The conditions applicable to each individual order, shall be those set out on the Site at the time the order is placed. Any new conditions shall be effective from the time of publication on the Site and shall apply only to sales concluded thereafter.

3. Offer to the Public

All products and prices indicated on the Site constitute an offer to the public with the limitations and modalities contained in the Site itself and in these general conditions of sale.

4. Products

The essential characteristics of the products are presented on the Site within each product technical sheet. However, the images and colours of the products offered for sale may not correspond to the real ones due to variations that may occur, imputable to the Internet browser and monitor used.

5. Prices

The prices of the products on sale, which are clearly visible in the appropriate product information sections, are inclusive of VAT.
The price does not include delivery service costs and eventual customs taxes applied for shipments to countries outside the European Union, which are to be borne by the purchaser.
The price calculated at the time of the order shall not take into account any price increases or decreases due to any promotions that may have taken place subsequently or that may have been concluded previously to the time of purchase.
Delivery costs shall be calculated according to the weight of the goods and according to the destination area and shall in any case be communicated before the order is concluded.

6. Acceptance of orders

The order sent by the Customer shall only be binding if the entire order procedure has been duly and correctly completed without any error messages from the Site. Caffè Italia will not include in the shopping list, products not expressly ordered by the Customer.

7. Order confirmation

The Customer will receive confirmation of the order placed, in his e-mail inbox, with a summary of the products and their prices. Orders are processed within 3 days after payment unless otherwise specified in the product screen. Orders received after 12h00 (noon) will be review the following day.

8. Delivery

The order will be delivered within 5/6 working days from the order processing. Delivery times may increase compared to the standard 3/4 days during Christmas, Easter and Ferragosto holiday period. For any anomaly encountered please contact Caffè Italia customer service at: Caffè Italia shall not be held responsible for any delays occurring during transport. Ownership of the products will be transferred to the purchaser upon delivery to the same by the carrier.
In order to help us resolve, in favour of the customer, disputes with the carrier in charge of delivery, related to damage suffered by the product during transport, we invite you to always accept the parcel with ” RESERVE CONTROL “, indicating in the waybill not only the words ” reserve Control ” but also the cause of the reserve, e.g. damaged parcel, opened parcel, destroyed parcel, wet parcel, tampered parcel, etc. This condition is necessary to open a claim against the courier and obtain compensation for the damage.

9. Unavailable products and purchase limitations

Caffè Italia shall, in no way whatsoever, be liable for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the products requested, Caffè Italia undertakes to promptly inform the Customer in the manner provided for by art. 54 of Legislative Decree 206/2005 and not to charge the Customer the corresponding price or, in case of advance payment, and if requested to refund the purchase to the Customer.

10. Non-delivery

Delivery requires the presence of the Customer or his delegate at the address indicated in the order. It shall also be the right of Caffè Italia to exclude the Customer from subsequent purchases or to subordinate the service to online payment. In the event of delay exceeding 3 days in retrieving the parcel or its non-retrieval by the customer, Caffè Italia shall be entitled to charge the additional costs incurred for the management or return of the goods to its warehouse.

11. Payment

The purchase can be paid by the Customer, at his choice, in the following ways:

11.1 Bank Transfer

When completing an order, you have the payment option of “Bank Transfer”.
The bank transfer must be made, under penalty of cancellation of the order, no later than 3 working days after the order is placed. The causal must include, in addition to the name and surname of the person placing the order, the order number and date.

Caffè Italia will wait for the reception of the total payment before executing the order. In the event that only part of the sum relating to the purchase is credited, Caffè Italia will be authorized to suspend shipment of the goods until full payment has been received. Caffè Italia will not charge any additional cost for payments made by bank transfer, while a commission fee may be applied by your Banking Institution.

11.2 PayPal

When completing your order, you have the payment option of “PayPal”.
You will be redirected to the PayPal page, where you will be asked for your account access-data to complete the payment. In case you do not hold a PayPal account, you will have the option to complete the payment by credit/debit card. The cards accepted by PayPal are: Mastercard, Discover, Visa, American Express, Maestro, Carta Aura.
Caffè Italia will not charge any additional fees for payments made through the PayPal system.

12. Invoice

Tax document (invoice or receipt) will be issued at the express request of the customer based on the data provided during the online order. A courtesy copy will be included in the package containing the customer’s purchase.

13. Right of withdrawal

In the case of online contracts or contracts negotiated out of the business premises, the Legislative Decree 206/2005, excludes the right of withdrawal for food products, as “[…] sealed goods are not suitable to be returned for hygienic, food safety reasons or when they have been opened after delivery.”

14. Responsibility

Caffè Italia guarantees compliance with all quality standards related to the products; any liability relating to the poor condition of the products due to improper handling after delivery is excluded.
Caffè Italia disclaims any liability for direct or indirect damages of any nature or in any form whatsoever resulting from the use of the Site and/or the news, photos and information contained therein. Any disputes relating to the performance of the service may be raised, under penalty of forfeiture, within 14 days after delivery of the products.

15. Privacy

Caffè Italia will process the Customer’s personal data in full compliance with Legislative Decree no. 196 of 30 June 2003 – known as the “Privacy Code” – and subsequent amendments, for example as specified in detail in the information in the “Privacy” section of the Site.

16. Jurisdiction

For any dispute that may arise in relation to the application, interpretation and execution of the present general conditions of sale, the Court of Crotone shall have exclusive jurisdiction.
